In 1998, Brazil issued a mandatory toy standard, NBR 11786/1998-Toy Safety; seven years later (that is, in 2005), the MERCOSUR (South American Common Market) standard NM -300 was adopted as a mandatory toy standard (The ordinance no.108/2005) ; Two years later, in 2007, Brazil introduced regulations DICLA 009, which added provisions for sampling testing, restricted overseas testing and required batch testing; in July 2009, Brazil issued the latest INMETRO toy certification draft directive (Ordinance  No. 210) and conduct public consultation; on October 29 of the same year, Brazil issued the final order (Ordinance No. 321), allowing overseas third-party laboratory testing.



Brazilian Toy Standards
       In terms of toys, the Brazilian standards are mainly ABNT NBR NM 300 "Toy Safety" series, where NBR is the Brazilian national standard and NM is the Southern Community standard. Brazilian toy standards refer to the international toy safety standard ISO 8124 and the European Union toy standard EN 71. In addition, ABNT NBR 14673 is quoted in the toy toxicology test requirements.

       Currently, the main standards and regulations related to toys in Brazil are as follows:

Certification Procedures for Brazilian Toys
      Toys fall under the category of compulsory product certification in Brazil. The main institutions responsible for testing and certification of toys in Brazil are: INMETRO (the National Institute for Metrology, Standardization and Industrial Quality) is the local management agency and organizer of product certification in Brazil; OCP (Product Certification Body) ), is a Brazilian local product certification agency recognized by INMETRO . Toys that pass the certification must be accompanied by the mandatory INMETRO logo and the logo of a third-party organization recognized by INMETRO before they can enter the Brazilian market.

       In 2009, Brazil proposed to relax its toy import policy and allow overseas laboratory testing. However, it needs to be tested in accordance with the Brazilian toy standard NM 300 by a laboratory accredited by the Brazilian National Institute of Metrology, Standardization and Industrial Quality (INMETRO).


1. Generally, manufacturers can choose the following two certification modes for product certification:
A. Mode 7: Toy batch certification
a. Submit application documents to the certification agency;
b. The certification agency reviews the documents and confirms the batch; c
. The testing laboratory draws samples and tests them. The number of toys tested depends on the batch size; d .
After passing the test, the certification agency issues a certificate

B. Mode 5: Quality Management System + Product Testing Certification Mode
a. Submit an application to the certification agency Documents and quality management system documents
b. The certification body reviews the manufacturer's quality management system documents;
c. The certification body conducts a preliminary review of the manufacturer's quality management system and draws samples for initial testing;
d. If the quality management system is reviewed and passed, samples are drawn If the test is qualified, a certificate will be issued;
e. Later supervision, review, and sampling testing

2. Testing: A laboratory accredited by INMETRO will issue a compliance test report according to the Brazilian NM 300 standard.
3. Conformity certification: When all certification requirements are met, the accreditation agency will issue a certificate of conformity.
4. Compliance mark: After passing the certification, a compliance mark must be affixed to the packaging or label and ensure that it is clearly visible.

Summary
The INMETRO certification mark can ensure a good source of products. Any toys without the INMETRO quality certification mark may be pirated or counterfeit products. Brazil’s toy safety certification not only raises the quality requirements for export products, but also raises the tariff threshold, causing toy products exported to Brazil to face double challenges. Relevant toy companies exporting to Brazil must strictly control the safety and quality of their own products, complete Brazilian toy safety certification in a timely manner , and avoid risks from the source.
